Received DMCA for Gifting

Just woke up, saw an email about broken links, and then this email. All the links to the translated novels are down. Not sure about drama CD.

One of the three emails I received can be found below.

    1. It's always Yenpress... Can they not just focus on one novel and translate it quickly. So that we might actually buy it.

      But now, it's just: " hey! This one is going to become an anime! Why not we translate this as well, and earn even more dosh!"

    2. Not sure if joking, or really that uninformed.

      Yen Press consistently releases titles with ~4 months between volumes. This is INDUSTRY STANDARD for these type of titles, something that you'd find to be the same with both Japanese and Western publishers of LN (hint: You can't edit text printed onto paper, the same way you can with a webpage).

      It's not as if having 20+ translators working on the same book going to make translating any faster, if anybody want the translation to have any sort of consistency and be actually readable, LOL!

      What makes the irrational dislike of YP look (to anybody willing to do a little fact check) even more irrational is that YP is one of the few publishers of translated LN that HASN'T actually left major titles in limbo for years with only lame excuses, or outright dropped titles wholesale.

      * Seven Seas: Don't even get me started on their treatment of the Boogiepop series
      * Viz Media: 2 volumes of Shakugan no Shana, then nothing since October 2007
      * Vertical Inc: 5 volumes of The Guin Saga, then nothing since October 2008
      * Digital Manga: 2 volumes of Hidan no Aria, then nothing since March 2014
      * Bento Books: 1 volume of Avatar Tuner, then nothing since July 2014

      That means we'll read volume 6 in 2 years, while previous volumes will be in similar translation quality as Skythewood's.
      Also don't let me get started on Overlord-we'll read vol.11 in 3-4 years in worse quality that here.

      Want a translation faster? Put your money where your mouth is, and privately commission a translation out of your own pocket.

    5. Man... just learn Jap... you would spend thousands with paying someone to translate to you... Learn japanese may sound hard... and yes it is I'm currently getting close to the two years mark but I already can read manga and understand novels to some extent with a dictionary... I bet that next year I'll be reading novels so... 3 or 4 years may sound a lot and it is, however, after that there is no more DMCA or waiting to get translated it... you just need to find the raws or buy the LN itself.

    I said because Log Horizon, Overlord, Mahouka (can someone tell other?) have been licensed more or less in the same time that appear the anime

    So it was predictable

    1. it doesn't need to be licensed by an english company to be DMCA'd. The author and the original publisher has the main right to do so in ANY and ALL language. Of course if there is an english publisher, the power to dmca is with them for english only.

      so yeah. it over buddy. well index to several years to get licensed even though there is an anime for it already.

      I think there are actual spies or snitch of the english publishers.

  18. More like DMCA it's autosearching of codewords. They most likely thought it had something to do with the upcoming anime whose license holds CR, I believe.

  21. I'd say to check the legitimacy of the claim. Does it tell you who is claiming copyright? I can't find anything saying the series was licensed. Some people were saying perhaps it's the illustrations that are getting the pages hit and all you would need to do is take off the illustrations. Hopefully it's just a troll or something.

    Site hosted on servers where nobody gives a damn about imaginary copyright infringement, torrents release, etc...


    (Why imaginary? The DCMA is technically an ISP protection law. Blogger is an ISP, skythewood.blogspot is an ISP too, in which Sky is editor-in-chief, his contributors are his writers, commentators included. Meaning any takedown request should go to Sky, then Sky remove whatever is offending if it actually is. Blogger has no fucking play in this and is not responsible for anything. And being a google company... with built in translation software and therefore de facto making MILLIONS of derivatives works everyday without proper authorization by their authors, it's not even hypocrisy anymore...)

  26. Why not start translating Chinese wuxia/xianxia novels? You won't receive DMCA messages like japanese-english translations. You can continue translating chinese wuxia/xianxia novel till you finish the series. Well of course if you can translate Chinese-English series. Or why not continue Youjo, update its status from Teaser Project to Main Project?

  29. If you actually want to republish it, you should use a different site other than blogspot. I would suggest using Godaddy as a registrar/ISP as they don't give a shit about copyright or illegal activity. Conversely, use ISPs in Russia or other countries that have poorly defined or are noncompliant with copyright laws.

    Again, this only actually matters if you want to republish Gifting. If you don't care about it, you can always just throw it away (although uploading the epubs/pdfs/mobis to a site like megaconz or megashare would be appreciated).

    4. I would like nothing more than to see this novel continue to be translated but Sky alrdy received a DMCA and he made it official so if he is caught continuing in secret he is liable to be sued. If someone new picks it up who nvr received a DMCA however is a different story.

    5. Skythewood, i don't know any TL sites that migrated but e-hentai is registrated by godaddy(http://whois.domaintools.com/e-hentai.org and as site works for years I think is reliable reference). Kissmanga however is registrated and hosted by rightside(lol, http://whois.domaintools.com/kissmanga.com) and protected by whoisguard(part of namecheap). You can check other sites which dont care about DMCA using above tool and select best hosting for you ;) IMHO, if they can't do anything to e-hentai or kissmanga they won't be able to do anything to sky too.

  33. in the future where machine translator or semi machine translator works provide a better results than in the present days you will find the ebook ln works sold from the it's home with languange change options attached. kind of steam or amazon like purchase. that's the direction we're currently heading or at least they (media publishers) planning that way.
    it's a bleak future for fan translator but maybe a bright future for piracy ? anyway they plan to make it really simpler for you to buy the works in a languange you prefer.

  45. Gifting is a Kadokawa series, and they've DMCA'd BT a few weeks ago, so any of their series (and they own A LOT) are at risk.

    Altina might be next, but Gate and Knight's & Magic are (IIRC) not Kadokawa owned, so they should be safe.

  52. Wow, so much ignorance in so many comments. Just to clear up some misinformation:

    * It doesn't matter if it's not licensed. A copyright owner in many foreign countries (Japan being one of them) gets reciprocity in the U.S. See http://www.copyright.gov/circs/circ38a.pdf if you care about details.

    * Never ignore a DMCA notice. If you think it's bogus, do a counter-notification... but only if you really know what you're doing, because that can up the stakes. See https://lumendatabase.org/counter_notices/new

    * GoDaddy is the *worst* host to use if you think you're going to have to deal with DMCA notices. They will take down entire sites over a bogus DMCA notification about a picture on one page, because they flat-out don't want to deal with that kind of stuff. Google/Blogspot actually isn't that bad, as far as hosting companies dealing with DMCA notices go.

    If you want an extra level of protection, use a host provider in another country.

    As to what to do: That's easy. Take it down.

    Ignoring a DMCA notice means the infringement becomes willful infringement, and that's the point where they can both sue you and feel pretty good about the chances that you'll end up paying their attorney fees to do so. That's not a game you want to play unless you really know what you're doing.

    4. The law for the DMCA to be honest can be considered outdated and taken advantage of in this digital age. While it states that the authors & publishers have full rights to their works and gets to decide who gets to translate it if ever at all.

      Which on the offset protects their works from bad translations and to prevent anyone making money off of their works.

      Now the big problem is this law also allows them to take down fan translations even if they are precise to a T. Translators like Sky dont profit from this(donations dont count) but are still liable simply because he doesnt hv permission to officially translate.

      Now YP after acquiring the license has all rights to issue a DMCA in regards to future profits(even if it irks me to no end) however the DMCA being taken advantage of is being seen especially for sites like BT nowadays.

      Extensively translated titles like Campione & Mondaiji which dont hv English licenses received takedown notices and now unreadable there. Now I'm sure a law student can state all the relevant clauses & sub clauses to DMCA but this is an extremely short summary

  54. Well this ruined my day, doesn't seem to be a way to continue hosting the Gifting series on this site. If you want to continue the series (which I honestly hope you do since you're one of the most reliable translators around), the best you could do is host it on another site.

    Unless there are more details such as who is filing the claim, fill out the error report. Following a DMCA from a legitimate party is one thing. Following a DMCA from a possible griefer is something else entirely.

    1. I saved ALLLL the light novels I read on my phone. So the licensed work I've read (Log Horizon, Mahouka, Oregairu, Gifting, etc) are safe with me. :D

      Bad news is that they're all txt format. My phone is old, can't handle epubs or pdfs.

At least if they pick it we won't wait 5 years to catch up with the Japanese version like Yen Press. Bookwalker is part of Kadokawa corporation which owns roughly more than half of all the published LNs.

    Sky the best choice would be the creation of a private site where all the translations will be visible only to registered members. However this means that you would have to maintain your own site.

  77. Well in my opinion it is easy to solve, there are 2 ways:
    1) Instead of directly post the content of the novels on blogspot you can just announce the release and them post a link to download (mega/mediafire/googledocs...)

    2) As suggested by others; move to another server hosted outside USA/japan/UK

  80. You know, Russia also has ranobe publisher. But you know what that guys did, when licensed SAO? They hired fan translator, who done all translation. That guy even learned Japanese, just because english translation stopped. Some editing here and there, and publishing speed is about 2 volumes a month now. Almost every volume sold out before printing. That guys have a right to complain about pirate translations.
    And yeah, i don't give a shit about yenpress, because they're lazy greedy bitches, who grabs everything and left everything unfinished. They don't have a right to complain about pirate translations.
    And Skythewood, remember: there is no way to delete something from internet :)

Yeah, sort of :) But i cannot understand one simple thing: why publishers, who have contract for whole series, digital sources and professional translators are so much slower than random guy, who doing translation in spare time? Random example: why i cannot buy or even preorder volume 10 issued 2 month ago when publisher licensed series since volume 2, that was issued 2 years ago?
      I know, Japanese is very tough, they want to be asked for approval of every dot on your cover and all, but not to that extent...

    2. the raw
    3. someone willing make the pdfs
    and then you can post it at google drives
    but you need many account and people who willing post it so eve one down we can find it at others....
    when it down make new google drive and post it again and repeat... it could said this endurance battle with the official

  83. Since there's literally thousands of responses already, my little suggestion here might get ignored. But what you could do is delete the current pages, then make a new page with links to somewhere else instead.
    Regardless though, I will respect your decision. Though it will be a shame if you drop the series since it's currently my number one favourite to watch, it can't be helped :3

  86. Sky...you can post it in Facebook if you want, some of the TL group do that in wake of DMCA, by creating a private group (invitation only), it will be somewhat difficult for them to check, because it is private.

  93. that's weird. if you check it closely, not all gifting is banned. just volume 1 and volume 2. maybe that is what the anime covered about for this season? since gifting volume 5 is still on, i don't see why you should stop it?

    1. i suggest you continue translating but do not archive it. make it like, you translate volume 6 chapter 1, then next week you delete volume 6 chapter 1 but you post volume 6 chapter 2. i wonder if that is good enough. but it is true right that only gifting volume 1 and volume 2 that is DMCAed? or does DMCA must applies to every volume? i don't know how this dmca works

    2. Because Gifting is a Kadokawa owned series and they're the ones who sent the massive DMCA list to BT a few weeks ago.

      Gate is owned by another company so its safe unless it gets licensed.

      You should be more worried about Altina, since its also a Kadokawa series.

  101. Im sad. A lot of unlicensed series have been getting hit. Nothing to do with TPP or Yen Press (lol hating yenpress!) TLs are always illegal under US law without permission when work is copyrighted, but it is up to the holders to enforce. Blame DMCA for how easy it is now I guess. Its sad but it a up to Sky. If you want to continue you should know godaddy is not a haven (eh: see banned content and exh and x eros.) Better off looking at hosts used by bsers like tazmo or whatever.

    Once they target a popular translation, they just post warning letter and their job is done. then they get paid, then they happy.
    And they don't target untranslated works, because they are just too lazy to do so...
